Shipment conditions
The items shipment is carried out within 3 or 4 working days via expressed courier from receiving the order. However, if some products are not available, you will be recontacted by our Customer Service, which will inform you about the timing of the shipment.
The products availability can be displayed in the appropriate products sheets and is indicated by the icon.
The minimal order amounts to € 40,00. The items prices are comprehensive of VAT.
 

Information note pursuant to the Legislative Decree n. 185/99 (D.Lgs n.185/99):
Since any purchase on our Website, as well as all remote purchases via telephone or mail, take place outside of our commercial premises, they are protected by the Legislative Decree N. 185 of May, 22 1999, which allows the consumer to exercise the right of withdrawal.
The consumer can exercise his/her right of withdrawal within 10 working days from receiving the items. This right consists in giving back the purchased items to the supplier without incurring any penalty and without specifying any reason, and it entitles the buyer to be refunded of the purchase price.

Exceptions:
The right of withdrawal is applicable to physical persons who act for purposes not related to their own professional activity. Therefore, items purchased by retailers and companies are excluded from the right of withdrawal.
Moreover, the right of withdrawal is not applicable to the following categories of products:
to) sealed media containing audiovisual or software material which have already
been opened by the consumer;
b) newspapers, periodicals and magazines.

How to exercise the right of withdrawal:
The right of withdrawal can be exercised by sending, within the foretold term of 10 working days from receiving the items, a registered letter with return receipt addressed to: ARTE OTTICA di Luca Esposito, via Roma, 53 - Montoro Inferiore (AV) - Italy
This notification can be sent, within the same term, also by means of a telegram or a fax to +039-825-502212 or by filling in the appropriate Form, provided that this notification is confirmed via a registered letter with return receipt within the following 48 hours. Such notification must contain the codes of the returnable products, as well as the indications related to the refund modes of the incurred fees (money order, money transfer, etc), as well as the appropriate banking coordinates.
The returnable products must be returned by the consumer, in conditions of substantial integrity, to the same address used for the registered letter.
Upon receiving the items and checked their integrity, Arte Ottica will credit the whole amount of the deposited sums within the shortest possible time (within maximum 30 days from receiving the notification with the returned products).


The right of withdrawal is applicable only if the customers complies with the following guidelines:

  • The right is applicable to the whole purchased products; it is not possible to exercise the right of withdrawal only to some parts of the purchased products (i.e.: accessories, supplied software, etc…);
  • The right is not applicable to sealed media containing audiovisual or software material (including the media supplied with the hardware), once they have been opened;
  • The purchased items will have to be complete and given back in their original sealing, together with all their pieces (including the packing and their necessary documentation and accessories: instruction manuals, cables, etc…); In order to limit damages to the original packing, we recommend, when possible, to put it into an additional box, by indicating the RMA number (Return Merchandise Authorization); it must be avoided - in any case – any label or adhesive tape attached directly on the original packing of the product;

  • According to the law, the incurred shipment fees in connection with the returnable items are at the customer’s expense;
  • The customer has to be kept liable for the shipped items, until our warehouse has confirmed their reception;
  • If items are damaged during their transport, we will inform the customer (within the 5th day from receiving the items in our own warehouse), in order to allow him/her to lodge a timely complaint to the chosen carrier and obtain the reimbursement of the items price (if they are ensured); in this case, the products will be made available to the customer in order to be returned, by canceling at the same time the right of withdrawal;
  • Arte Ottica disclaims any responsibility for damages or theft/loss of the items given back by means of not ensured shipments;
  • Upon arriving into the in warehouse, the products will be checked in order to evaluate possible damages or thefts not related to their transportation. If a packing and/or an original packing are damaged or each of its part is missing, we will inform the customer and we will cut the price of the missing piece (if possible), or the item will be made available to the customer in order to be returned at the customer’s expense.
